Crypto-anarchy is over:
While crypto enthusiasts are busy drawing their charts all the way to the moon, European regulators have landed there with thick volumes of legislation in tow. The era of the digital Wild West is officially over. Ahead lies the harsh reality of dual compliance — enough to make even the most incorrigible blockchain optimists shudder.
In place of regulatory anarchy, Europe has built a two-pillar system of control. The first pillar — the MiCA Regulation — has cleaned up the market through strict licensing of crypto-asset service providers and rigorous reserve requirements. The European Banking Authority has already prohibited investing those reserves in anything other than ultra-high-liquidity assets, effectively equating stablecoin issuers with systemically important banks.
But the true nightmare for traditional banking and fintech came in the form of the second pillar — the TFR Regulation. Here, a zero-threshold principle applies without compromise. Every crypto transfer, even for one euro cent, must be accompanied by complete and verified data on both the sender and the recipient. Pseudo-anonymity has been reduced to zero. In Ukrainian regulation, the devil is in the details. First, the conflict between the National Bank of Ukraine and the National Securities and Stock Market Commission continues — despite the fact that, under the logic of MiCA and IOSCO, tokens should fall under the remit of the NSSMC as the dedicated sectoral supervisor. Second, the dangerous idea of automatic authorization without verification of information documents not only closes the door to Europe for us, but directly threatens national security by opening the door to providers from the aggressor state.
Treating these European frameworks as yet another piece of bureaucratic paperwork is financial suicide. Proactive action is essential here.
