When a Verdict Is Not the End of the Story
A client was convicted by a court of first instance under Part 2 of Article 286 of the Criminal Code of Ukraine and sentenced to 6 years of imprisonment, being taken into custody in the courtroom. At first glance, the situation appeared nearly hopeless.
The client came to us after the conviction had already been handed down.
Our lawyers conducted a comprehensive analysis of the case materials — in particular, a thorough review of the expert conclusions on which the prosecution was based. The central issue was the causal link between the injuries sustained in the road accident and the death of the victim.
On this basis, a clear legal position was developed and an appeal was prepared. Before the appellate court, we successfully established that:
▪️ the conclusions of the court of first instance did not correspond to the actual circumstances of the case; ▪️ the existing circumstances cast doubt on the accuracy of the prosecution's classification of the offense, and therefore on the severity of the charge brought against the client; ▪️ the trial had been conducted with significant gaps in the examination of the evidence.
Today, the client is at home, and the case has been given the opportunity for a full and impartial review.
This case is a reminder: even after a verdict, the fight for justice remains possible. What matters most is professional analysis and the right legal strategy.
